Abstract

This paper examines the constitutional role of minors from the perspective of criminal law and the relevance of the best interests of the child principle within contemporary constitutionalism. The study explores how child protection is recognised at the constitutional level and how these principles influence legal regulations concerning juvenile criminal liability. The research is based on a comparative analysis of the constitutional and criminal law frameworks of Romania and the Republic of Moldova, focusing on constitutional provisions related to child protection, the legal regime of juvenile criminal liability, and the jurisprudence of the constitutional courts. At the same time, the study highlights the influence of international and European standards on child protection, particularly the United Nations Convention on the Rights of the Child and the Charter of Fundamental Rights of the European Union. The findings indicate that the protection of minors represents a fundamental constitutional value in both legal systems and that the application of the best interests of the child principle leads to legal solutions focused on protection and social reintegration of minors in conflict with criminal law.
